WITNESS EVALUATION

We review video deposition testimony or mock sessions from the current case (if available). Alternatively, we can review transcripts of trial or deposition testimony from previous matters, especially in the case of expert witnesses.       Counsel is presented a critique of testifying strengths and problem areas, including a plan for skill building in the current case.

VIDEO DEPOSITION PREPARATION

A brief mock video deposition is conducted and reviewed with the witness and counsel in order to establish a baseline.

     The witness will then be taught: 1) the purpose of a deposition, 2) why they are often videotaped, 3) how deposition excerpts may be used during trial, 4) what kinds of questions may be asked at a deposition, 5) strategies for responding to deposition questions, and 6) the importance of witness demeanor throughout the deposition.

     A second mock video deposition will then be conducted and critiqued.

TRIAL TESTIMONY PREPARATION

Experienced litigators are often painfully aware of challenges presented by preparing witnesses for trial testimony, e.g.: 1) company witnesses who have little to no experience testifying, 2) corporate executives who are used to being "in charge" and are uncomfortable with the constraining rules of testifying, or 3) experts who present their often complex testimony and opinions to fact-finders who have little to no familiarity with such technical material. 

     iWitness consultants are experienced in the art of teaching what makes effective and appropriate courtroom communication. We help witnesses convey key case facts, themes, and/or opinions more clearly, confidently, and credibly.
